NOTE This is ONLY for "Voice Dialing". When you switch it is says "voice command for music is always active".
STEPS

OPEN SETTINGS. Tap the Settings icon on your home screen. 2
TAP ON GENERAL. This opens the General control panel. 3
TAP "PASSCODE LOCK." Then tap "Turn Passcode On." 4
ENTER YOUR PASSCODE. Enter 4
numbers that will be easy to remember, but hard to guess. 5
TURN VOICE DIAL OFF. After you've enabled your passcode, tap the Voice Dial toggle to flip it from On to Off. While you cannot totally disable Voice Control, this will at least disable it when your screen is locked. Note: if you disable the passcode, Voice Control will automatically be enabled from the lock screen. [1]
TIPS
If you have an iPhone 4S or later, activating Siri will de-activate Voice Control. (NOTE: This only turns off Siri and turns the normal voice control back on!)
If you must totally disable Voice Control, you can jailbreak your iPhone, and use a hack. Check sources like http://www.iphoneforums.net/forum/submission-area-73/disable-voice-control-40527/ or http://www.ijailbreak.com/iphone/cydia-tweak-disable-voice-control/, or search Google for the latest tweaks for Cydia.
